About these terms
These terms govern access to the Seamless AML consulting website and its New Zealand and Australian market pages. By using the website, you agree to these terms. If you do not agree, the website should not be used.
The website is operated for the separate Australian and New Zealand companies trading as Seamless AML. The company responsible for paid work will be identified in the engagement documents. AskAML is a separate product and is not governed by these website terms.
General information only
Website content is general information. It is not legal advice, financial advice, a formal AML audit or evaluation opinion, or advice tailored to your facts. AML obligations depend on the relevant law, rules, sector, services, risks, regulator guidance and circumstances at the time.
No decision should be made solely from this website. Current legislation, rules and regulator material should be checked, and professional advice should be obtained where needed.
No client relationship
Viewing the website, sending an enquiry or receiving a response does not create a client relationship and does not require Seamless AML to accept work. An engagement begins only when the required engagement documents have been accepted, conflicts and independence checks have been completed, and any required deposit has been paid.
Information sent before an engagement is accepted may be used to assess the request and check whether the work can be undertaken. Do not send confidential client files, identity documents, CDD records, SAR information or SMR information through a public form.
Accuracy and currency
Reasonable care is taken when website content is prepared. However, laws, rules, guidance and regulator positions can change, and website content may not reflect a change at once. No promise is made that every page is complete, current or suitable for a particular business.
If an error is found, it may be reported to casey@seamlessaml.com. Content may be corrected, replaced or removed without notice.
Australia and New Zealand pages
The site uses an approximate country signal and a market preference cookie to select Australian or New Zealand wording. These controls are provided for convenience and do not decide which law applies to you.
You must select and use the material that matches your reporting entity and services. If a group operates in both countries, separate legal requirements may need to be considered.
Enquiries and quotes
An online estimate, service description or initial response is not a binding offer unless it is stated to be one. A formal proposal may be withdrawn or changed before it is accepted. Fees are exclusive of GST unless the proposal states otherwise.
Information supplied in an enquiry must be accurate and must be provided with proper authority. Another person must not be impersonated, and another organisation's confidential information must not be supplied without permission.
Acceptable use
You must not:
- use the website for an unlawful, fraudulent or harmful purpose
- try to gain unauthorised access to the website, its data, accounts or hosting systems
- introduce malicious code, overload the service or interfere with another visitor
- scrape, copy or index substantial parts of the website except through ordinary search-engine activity or with written permission
- remove notices, misrepresent content as your own, or use the Seamless AML name or marks without permission
- submit sensitive client information through a public form
Access may be restricted where misuse, a security risk or a breach of these terms is reasonably suspected.
Intellectual property
Unless stated otherwise, the website, its wording, design, graphics, trade marks, methods, downloads and other material are owned by or licensed to Seamless AML and are protected by intellectual property law.
You may view the website and print or save a reasonable copy for your own internal business use. Material must not be republished, sold, adapted, used to build a competing product or included in a template library without written permission. Legislative and regulator materials remain the property of their respective owners.
Links and third-party services
Links to legislation, regulators and other websites are provided for convenience. Those sites are controlled by others. Their content, availability, security and privacy practices are not controlled or endorsed by Seamless AML unless that is stated.
You should check the destination and its terms before providing information or relying on its content.
Availability and security
The website may be changed, suspended or unavailable due to maintenance, faults, security events, provider outages or matters outside our control. Continuous or error-free access is not promised.
Reasonable security measures are used, but no public website can be guaranteed to be free from harmful code or unauthorised access. You remain responsible for your devices, accounts, backups and network security.
Liability and legal rights
To the maximum extent permitted by law, Seamless AML is not liable for loss arising from reliance on general website content, use of a third-party site, or website interruption. This does not exclude or limit any right, guarantee or remedy that cannot lawfully be excluded or limited.
Liability for paid consulting work is governed by the accepted engagement documents, not these website terms.
Privacy
Personal information submitted through the website is handled under the Seamless AML Privacy Statement. The statement also explains the market preference cookie, website hosting, access rights and how a privacy complaint can be made.
Changes and severability
These terms may be changed by publishing a new version and effective date. The terms applying when the website is used will govern that use.
If part of these terms is invalid or cannot be enforced, it will be read down or removed to the minimum extent needed. The remaining terms will continue.
Governing law and contact
If you use the Australian market pages, these website terms are governed by the law of New South Wales, Australia. If you use the New Zealand market pages, they are governed by New Zealand law. This does not prevent a mandatory law from applying.
